CONTRACT OFFER

Public offer (license agreement) for data publication

The Federal State Unitary Enterprise the “Academic scientific-publishing, production, printing and book distribution centre “Nauka” (hereinafter referred to as the Publisher) proposes to the public (hereinafter referred to as the Author) to make the agreement on data publication in the journal published by the Publishing House.

  1. Terms used in the Contract

The Offer Acceptance is the full and unconditional acceptance of the Offer through the implementation of the actions specified in clause 3.1.of the Offer. The Offer Acceptance creates a license agreement, concluded verbally.

The Author is an individual (s), who create(s) article(s).

The Application is the Author’s electronic request to the Publisher for placing the Article in the Publication by sending the Article through the website or by e-mail.

The Publication is the scientific journal “CTRI Bulletin”, published by the Publisher.

The Publisher is the Federal State Unitary Enterprise the “Academic scientific-publishing, production, printing and book distribution centre “Nauka”.

The Offer is the given document published on the site http://www.naukaran.com/.

The Article is a scientific article in the form of textual material submitted by the Author for publication in the Publication.

  1. Subject of offer.

2.1. Under this Contract, the Author grants the Publisher in full the exclusive right to the Article belonging to him.

2.2. The exclusive right to the result of intellectual activity transferred under this Contract means the exclusive right provided for in the article 1270 of the Civil Code of the Russian Federation and shall be transferred to the Publisher in full in relation to any use of the Work throughout the globe, with the possibility of its transmission in whole or in part including licensed, to any persons under the conditions determined by the Publisher.

2.3. The Author transfers the exclusive right to the Publisher gratis.

2.4. The Author authorizes the Publisher to publish the Work in any way at its own discretion.

2.5. The Author guarantees that the conclusion of this Contract will not lead to a violation of copyrights or other intellectual property rights of third parties, and that they have not made and will not make in the future any contracts providing for the alienation of the rights to the Article or the provision of any exclusive or non-exclusive licenses to use this Article.

If the Author uses borrowed materials (illustrations, quotations, tables, etc.), he is obliged to have permission to use them in the Article from the copyright holders.

2.6. A confirmation authorization for each individual borrowing should be attached to the manuscript of the Article proposed by the Author for publication in the journal.

2.7. The Author has the right to freely use the Article for personal, informational, scientific, educational, cultural purposes in accordance with the legislation of the Russian Federation without obtaining the permission from the Publisher.

  1. Acceptance of offer and conclusion of contract.

3.1. The Author accepts the Offer by ticking off the tick box “I have read and agree with the terms of the offer” in the “Submit a manuscript” section.

  1. Term and change of offer conditions.

4.1. The offer comes into force from the moment of its publication on the official website of the Publisher in the information and telecommunications network of Internet http://www.naukaran.com/ and is valid until the withdrawal of the Offer by the Publisher.

4.2. The Publisher reserves the right to amend the terms of the Offer or withdraw the Offer at any time at its discretion.

  1. Term of Contract.

5.1. The Acceptance of the Offer by the Author creates a License Agreement concluded on the terms of the Offer (the article 438 of the Civil Code of the Russian Federation).

5.2. The Parties have agreed that the Contract is considered settled in writing after the Offer Acceptance by the Author.     

5.3. The Contract shall come into force from the date of the Offer Acceptance by the Author and is valid for 5 (five) years from the date of the Offer Acceptance.

5.4. This Contract shall come into force only if the Article is accepted (approved) by the editorial board of the journal for publication.

  1. Other terms and conditions

6.1. In all that is not directly regulated by this Contract, the Parties are governed by the legislation of the Russian Federation.

6.2. This Contract is made in duplicate, one for each of the Parties. Here, the Parties have agreed that the Contract in writing will be respected, including when the exchange of documents is effected through postal, telegraph, teletype, telephone, electronic or other communication, allowing reliably ascertain that the document originates from the party to the contract.

6.3. Without coming into conflict with the terms of the Offer, the Author and the Publisher have the right to issue the License Agreement at any time in the form of a written bilateral document.

6.4. The Author’s Application is Appendix No.1 to the License Agreement and is its integral part.
